It really depends on your motive for using it. It's kind of a gray area. If you're using it to help with pain or to sleep better there are alternatives.
Well, it is technically psychoactive, however does not result in euphoria or have an intoxicating effect. As Matthew said, this is where motive comes into play.
If your taking it for pain I say yes your still sober but if it’s for a different reason then no not sober. I have taken gummy’s for my back to keep me off pain killers but I also don’t take them constantly. If you can get by with Tylenol or Motrin first I’d say those first for sure 
Both me and my Fiancé eat gummy’s once in a while for pain. We usually take Motrin or Tylenol.

Here is how I look at it as long as you are using as directed and not over using I totally say yes. You can put that question to anything if I eat x y or z , if I sleep around, meaning what behaviors are you doing that mimic the same compulsions as using whatever chemical you are attempting to abstain from. I am probably going to catch a lot of grief for this comment or maybe not. Either always look at motivation for any behavior or for whatever you put into your body. You know you and furthermore you know your reaction to a chemical or behavior on how beneficial or harmful it was, is or could be. This is not advice and I am not a clinician. These are just things to ponder and do your own research and listen to yourself and honestly need. Be well and be safe and keep up the good work of asking questions.
