2nd DUI, stress and sadness

Your gonna b just fine bro... I remember when I got my 2nd DUI. . I wouldn't worry too much about a lawyer , a 2nd DUI is a fairly str8forward matter , a public defender should probably get u the same deal. Start your DATS ( IOP ) and AAs now so it'll look good 4 court. They'll probably wanna give u 30 days in jail but u should b able to do it on house arrest. It's possible they even give it to u in a suspended sentence. The main thing they're gonna try and hit u up for is your money , and fine the s*** out of you. No worries... just don't pay it. I didn't. A misdemeanor DUI isn't a high priority. After a while those warrants will become inactive and fade away. Unfortunately u might lose your license 4 a minute , but hopefully not more than a year. Thats ok you'll b able to handle it. I did 4 months house arrest for my 2nd DUI but that's cuz I was driving on a suspended license from my first one. Yeah this will all work itself out , just hang in there.

I was just arrested for my first 4 weeks ago... I did so well for years in recovery and then this happens. I'm staying positive, I'm spending a lot on an attorney, and back in my recovery program. I'm scared and hurting myself, I drive for a living so. Just taking it day by day and doing everything that I can control. All else is in god's hands.

I got 3 man. Itā€™s a tough thing to deal with. Totaled two cars in the process, and totaled a third in a drunken and benzo high that I didnā€™t get caught for. Did almost 2 months in jail for my 2nd one, over Christmas many many years ago. I did some work, paid my consequences, and now I have both my counseling licenses back, Iā€™m a licensed mental health therapist and a licensed addictions therapist. Things can and do get better man, just takes time (patience), and some work. Reach out if you ever need or wanna chat with someone who has been there and has recovered and moved on to positive things on life. You got this my man.

I got sober after my 8th dui. Iā€™ve been sober over 7 years now. I have not gotten arrested since I got sober. You can do this a day at a time. Find your tribe in AA and enjoy the ride. Youā€™ll be fine as long as you donā€™t pick up the first drink.

and remember No amount of guilt can change the past and no amount of anxiety and stress can change the future. Just take it one day at a time. Youā€™ve got this buddy :muscle:

Be proactive with classes and treatment, any thing you can to look good for the courts

Youā€™re in the right place. Try not to project into the future and just think about staying clean for today! The rest will work itself out but definitely do Your meetings and an outpatient program if you can to look good for court. Welcome again!

Just be grateful you didnā€™t kill anybody !!

Wow, so you got 2 months in jail for your second DUI? I think they are recommending 30 days jail time for me. But then I hear people saying it'll probably be house arrest? I can't afford a lawyer and I make too much to get a public defender.

I make too much for a public defender. I didn't get one when I was arrested and held for that period. There happened to be a lawyer trying to drum up business and represented me pro bono. That was great, bc it got me outta jail! But now I had a free consultation with him afterwards and he wants a flat fee of $6k. I'm like NOPE! But what the heck to do?

Thanks Sarah, I'm in AA before this happened too. I've got a form I take around with me now and have someone at the meeting sign and date it with their name and meeting name. I want to show the court that I'm serious about my recovery. So you are saying starting addiction therapy would look good too? Makes sense. I will look into that. I was thinking I will have my sponsor come and vouch for me at the court date too. I make too much for a public defender but I can't afford a real lawyer either. So I think I'm on my own for this. What else can I do to prepare for the court date?

I've had 7 it's all good. Recommend you go to treatment of some kind before your case is resolved

I did the process you are about to start!! I went to meetings everyday. Had my sheets signed. Sometimes 2 meetings a day. I did a out patient rehab recovery program that I qualified in my county for. Had my sponsor at court with me but I did have a laser. She told me to do exactly what you said. And it kept me out of jail. I was charged with a felony dui and it saved me!!! Wishing all the best!!

It was actually 45 days, so close to 2 months. Every state has their own laws/consequences when it comes to this situation. I got mine in 3 different states and only two of those states share databases, so when I got my 3rd in NC, they only saw it as my 1st cause they donā€™t share with Tenn. and Va, where my first two were. Had they charged me with my 3rd, I most likely would have got 1 year jail. And Iā€™ve seen some people on here with 5+. Some states consider that to be habitual, if done in a certain amount of time, and then it becomes a felony, with the potential for years in jail. A guy I was in jail with in Tenn, had 7 or 8 and his became felonies and he got like 2-3 years jail. Every state is its own and if I were you, Iā€™d look into the laws in your state and try and see what they say. Some people in here may be correct, but they might not be if they are in other states. Thereā€™s usually a legal aid place in most areas where you can get free legal services for guidance on things. Not representation, but just some guidance. Good luck man, but stay positive, either way, youā€™re gonna be fine. Just gotta go through the process.

It depends on how close the duiā€™s were to each other. My guess is either 10 days in jail/house arrest or theyā€™ll have you serve them in blocks..you sleep in your own bed and show up to a holding cell for 12 hours a day for 10 days. If you donā€™t have a record outside of this prob house arrest but Iā€™d be prepared for 10 days.
