Ok so ive had a few DWI in the past. One was in late 2018. They filed the paper work in the spring of 2019 but i never got a court date. Later on i got abother dwi in a different county. So that county uped it to a felony charge. Went through all the court junk , ankle monitor then probation(which I finished early) i open the mail box today and there is a letter from the other mentioned dwi from 2018. They set a court date for 2026. Literally made my stomach drop. I dont understand it. 7 almost 8 years later. Never had a court date and never had a warrant for it.

I’m going through what you are going through now. 10 yrs probation. Trying to get my occupational license, probation once a month. And other things, but it beats going to prison.

I would get a lawyer. I know in San Bernardino county when I got my last dui (same time as yours), the law was that if the D.A. doesn’t file a case within a year, it the dui is dropped. Hopefully a lawyer can drop it for you. This shouldn’t have happened to you. Best of luck to you.

Yeah it was before right before covid to and I don't know if that and a back log of cases factor into it. But even if it does its grounds to dismiss Hopefully because its been 7 years since they filed snd never set a court date that I know of and if I did have one, I would have missed it and would have had a warrant. I was arrested after that so the neighboring county would have said something and probably transferred after that. But, that never happened. So its really annoying to be dealing with it after I just went through all this other junk and I was finally off if any paper work.
Yeah i contacted a lawyer and have a phone meeting for Monday afternoon. Was the first thing I did after I got the letter for the court date.
