The Family and Medical Leave Act (FMLA) gives eligible employees up to 12 weeks of unpaid, job-protected leave, and substance use disorder treatment qualifies as a serious health condition. The Americans with Disabilities Act (ADA) also protects employees who are actively seeking treatment from discrimination. The key is that the protection kicks in when you’re seeking treatment, not just missing work because of using. Depending on your state, there may be additional protections too.
